ANJANA MISHRA ORAL ORDER 18-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Bhangaha P.S. Case No.36 of 2016 for allegedly having committed the offence under Sections 147, 148, 149, 341. 323. 307, 302 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no specific allegation of assault against the present petitioner and the other accused are said to have attacked the informant but as stated, only the participation of the petitioner is said to be there in the aforesaid occurrence. Considering the aforementioned facts and

No.27630 of 2017 (2) dt.18-07-2017 2/2 circumstances of the case and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, West Champaran at Bettiah, in connection with Bhangaha P.S. Case No.36 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
