In this case, the petitioner is seeking anticipatory bail in connection with Baushi P.S. Case No.34 of 2023 registered for the offence punishable under section 341, 323, 307, 498-A/34 of the Indian Penal Code and under section 3/4 of the Dowry Prohibition Act.

Allegation against the petitioner and other accused persons is that they have tortured the informant for demand of dowry and also tried to kill her.

At the outset, learned counsel for the petitioner submits that the petitioner is ready to pay
Patna High Court CR. MISC. No.27254 of 2024(2) dt.01-05-2024 2/2 maintenance of Rs.4,000/- per month to the opposite party no.2 (wife).

Considering the fact that the petitioner is ready to pay maintenance to the opposite party no.2 and also considering the law laid down by the Hon'ble Apex Court in the case of Arnesh Kumar vs. State of Bihar reported in (2014) 8 SCC 273, this bail application is allowed.

Let the above-named petitioner, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M.- 1st Araria, in connection with Baushi P.S. Case No.34 of 2023, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Sandeep Kumar, J) pawan/- U T
