ANJANA PRAKASH ORAL ORDER 20-05-2015 Heard learned counsel for the Petitioner and the State. The Petitioner was granted anticipatory bail by the order dated 9.1.2014 passed in Cr. Misc. 37753 of 2013 in which one of the conditions was that an affidavit would be filed on his behalf that he has fair antecedent, but, since there was another case in which the Petitioner was subsequently acquitted, he would not derive the benefit of the same.

Considering that this is a second application for anticipatory bail which is not maintainable, the same is disposed off with a direction to the Petitioner to appear before the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Durgawati P.S. Case No. 98 of 2013, which shall consider the fact that the Petitioner was found fit to be released on anticipatory bail

Patna High Court Cr.Misc. No.33397 of 2014 (2) dt.20-05-2015 2/2 on merits by this Court and that he has been acquitted in other case.
