JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Hajipur Excise P.S. Case No. 163 of 2023, registered for the offence punishable under Sections 30(a), 32(1)(2) & 41(1)(2) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioners submit that the petitioners are innocent and falsely been implicated in this case. Petitioners have no criminal antecedent. No incriminating material has been recovered from the conscious possession of the petitioners. Petitioners are in custody since 02.03.2023. Learned APP has vehemently opposed the prayer for

Considering the nature of allegation levelled against the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail after completing six months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise, Court No.-II-cum-Addl. District & Sessions Judge, Vaishali at Hajipur in connection with Hajipur Excise P.S. Case No. 163 of 2023.
