2. The petitioner seeks regular bail in connection with Nabinagar P.S. Case No. 18 of 2025 lodged on 19.01.2025, for the offence punishable under Sections 140, 70(1) and 3(5) of B.N.S, 2023, pending in the Court of learned District and Addl. Sessions Judge-1st-cum-Special Judge (SC/ST, NDPS & Children Act), Aurangabad.
3. Prosecution case, in brief, that some unknown persons/miscreants committed rape upon the informant, aged about 20 years, while she visited outside with her boyfriend, namely, Salman Khan.
4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Learned counsel further
Patna High Court CR. MISC. No.22918 of 2026(6) dt.23-07-2026 2/2 submits that petitioner is innocent and falsely been implicated in this case on the basis of mere suspicion. Counsel lastly submits that the petitioner is in custody since 20.01.2025.
5. Learned APP for the State vehemently opposes the prayer for bail of the petitioner and submits that two cases pending against the petitioner.
6. Having heard the parties and taking into account the nature of offence and the fact that the trial is at the flag end, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
7. It is expected that the Trial Court will conclude the trial within a period of three months.
