The matter has been taken up through video conferencing.

The petitioner seeks bail in Ayar P.S. case No. 30/2020 registered u/s 341, 323, 307, 504, 34 of the IPC. The informant alleged that when he came to his house the petitioner, his brother, Vikash Kumar, on the order of Indu Devi assaulted him with Lathi. The informant got injuries on his head.

The learned counsel for the petitioner submits that there is counter version being Ayar P.S. case No. 31/2020. The doctor found fracture injury on the head. The petitioner is alleged to have assaulted the informant with Lathi but he is in jail since 08.04.2020. The petitioner has already remained in jail

Patna High Court CR. MISC. No.25885 of 2020(2) dt.13-10-2020 2/2 for more than six months.

It appears that petitioner and his brother are alleged to have assaulted the informant with Lathi on his head but the doctor found simple fracture injury on the head of the informant. There is case and counter case and the petitioner has remained in jail for more than six months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ayar P.S. case No. 30/2020.
