JUSTICE RAKESH KUMAR ORAL ORDER 13-07-2017 Heard Sri Sunil Kumar Pandey, learned counsel for the petitioners and learned Additional Public Prosecutor. The petitioners, apprehending their arrest in Maner P.S. Case No. 141 of 2017, registered for the offence under Section 290 of the Indian Penal Code as well as Section 30(a) of the Bihar Prohibition and Excise Act, 2016 have prayed for grant of bail in the event of their arrest or surrender. It was submitted by learned counsel for the petitioners that there is no material to connect them and in complete illegal and false manner petitioner has been made accused only on the secret information of the Police on the plea that huge quantity of Indian make foreign liquor was recovered from the field. No.30168 of 2017 (2) dt.13-07-2017 2/2 arrest or surrender within a period of six weeks from today, let both the petitioners namely (1) Lalu Kumar and (2) Sudama Rai @ Byash Ji be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Spl. Judge Excise Cum Addl. Sessions Judge IV, Patna / concerned court in connection with Maner P.S. Case No. 141 of 2017 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure 1973.
