It has been alleged that petitioner along with others came and on the pretext of firearm, took L.T.I. of the informant, also assaulted with butt of pistol then thereafter, firing in air, all of them left the place.

From perusal of case diary, it is apparent that there happens to be no whisper with regard to use of stamp paper carrying L.T.I. of the informant. In the aforesaid background, it cannot be termed as valuable security and that being so, happens to be no application of Section 385 I.P.C. With regard to remaining offences, that appears to be casual in nature. Accordingly, petitioner is directed to surrender before the learned lower Court with a prayer for bail which, the learned

Patna High Court Cr.Misc. No.34698 of 2014 (03) dt.20-05-2015 lower Court will consider favourably in light of aforesaid fact. With the aforesaid observation, instant petition is disposed of.
