ANJANA MISHRA ORAL ORDER 14-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Bairiya P.S. Case No.29 of 2017 for allegedly having committed the offence under Section 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that the name of the present petitioner was taken by the brother of one co-accused Kundan Kumar from whose possession the alleged recovery of motorcycle was made. Learned counsel for the petitioner further submits that on the statement made by the said brother, the petitioner has been roped in in connection with
Patna High Court Cr.Misc. No.27685 of 2017 (2) dt.14-07-2017 2/2 the present case.
Considering the fact that there is no recovery from the possession of the petitioner and only on the basis of the statement made by one co-accused, the petitioner's name has been taken, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIV, Bettiah, West Champaran, in connection with Bairiya P.S.
