ANJANA PRAKASH ORAL JUDGMENT Date: 31-07-2015 The Petitioner seeks revision of the judgment of conviction dated 29.8.2005 passed by the Additional Sessions Judge, F.T.C. No.V, Sitamarhi in Criminal Appeal No.5 of 2003/41 of 2004, by which he has upheld the conviction of the Petitioner and maintained the sentence of six months R.I. and fine of Rs.2000/-, in default of which simple imprisonment for another three months passed on 19.2.2003 by the S.D.J.M., Sheohar, Sitamarhi in G.R. case No.285 of 1993 (Trial No.468 of 2003).
Having gone through the impugned judgment, I do not find any merit in the application. However, considering that the occurrence had taken place way back in the year 1993, the sentence is modified to the period already undergone by him. However, he is required to deposit the fine as directed by the Court below within a
Patna High Court CR. REV. No.743 of 2005 dt.31-07-2015 2/2 period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.
With the aforesaid modification in sentence, the revision application stands dismissed.
