02. In the present case, the petitioner seeks bail in connection with Deodha P.S. Case No. 107 of 2025 registered for the alleged offences under Sections 80 r/w 3(5) of Bharatiya Nyaya Sanhita, 2023.

03. As per prosecution case, petitioner was married with the daughter of the deceased sister of the informant. There is allegation of demand of motorcycle and cash from the victim. On 26.09.2025, at around 10:00 PM, the informant came to know that her adopted daughter was dead.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence in the manner as alleged has ever taken

Five persons have been made accused in this case but there is no specific allegation against any of them regarding demand of dowry and torture and consequent killing. The petitioner never demanded anything from the victim. Learned counsel further submits that the victim committed suicide and information was given to the informant who also reached the Sub-Divisional Hospital, Jaynagar as is evident from the FIR. Thus, it is very much clear that the petitioner and his family members took the victim to the hospital for her treatment and if they would have killed her, they would not have taken her to the hospital. Learned counsel further submits that in this manner, there is only suspicion against the petitioner.

Learned counsel further submits that the family of the petitioner tried to save the victim but she did not survive and subsequently, died. Learned counsel further submits that all the witnesses have stated that the victim hanged herself and committed suicide. The petitioner is in custody since 27.09.2025 and charges have been framed against the petitioner. The petitioner has got no criminal history.

05. Learned APP for the State as well as learned counsel appearing on behalf of the informant vehemently oppose the submission made on behalf of the petitioner. Learned counsel for the informant submits that the petitioner is the

Learned counsel further submits that the postmortem report supports the fact that the victim was strangulated, as cause of death is stated to be asphyxia caused by strangulation.

06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the postmortem report supporting the allegation of causing death by the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, his prayer for bail is rejected.

07. The learned trial court is directed to expedite the trial and conclude the same at the earliest.
