Learned counsel for the petitioner is permitted to implead the Treasury Officer, Supaul as respondent no. 5. Let necessary correction be made during the course of the day. It appears that now the grievance of the petitioner stands restricted to actual payment on account of revision of his pay as per the 6th Pay Revision Commission and also payment of promotional post and consequent to the same revision of his pensionary benefits.
Patna High Court CWJC No.16853 of 2015 dt.20-08-2016 2/3 As per the stand of the respondent no. 3 in his counter affidavit, the pay fixation of the petitioner in the revised pay scale with effect from 01.01.2006 has been done and his pension has also been calculated in the revised pay scale and sent for necessary revision to the Accountant General, Bihar. It has further been stated that difference in pension amount would be paid through treasury for which steps have been initiated. The counter affidavit also states that with regard to the payment of the promoted post with effect from the date of promotion instead of date of joining, the same has been redressed under Supaul District Order dated 08.01.2016. Having considered the aforesaid, the writ petition stands disposed off in the following terms:
(i) The Accountant General, Bihar (respondent no. 4) is directed to ensure that actual payment with regard to arrears on account of fixation of revised pay scale with effect from 01.01.2006 as well as payment to the promotional post is made to the petitioner within four weeks from the date of production of a copy of this order before him.
(ii) Similarly, the revised pension amount would also be paid to him after issuance of revised P.P.O. by the respondent no. 4 within the same period.
(iii) The newly added respondent no. 5 shall ensure that
Patna High Court CWJC No.16853 of 2015 dt.20-08-2016 3/3 upon necessary order issued by the respondent no. 4, the actual payment is also credited to the account of the petitioner within three weeks thereafter. A copy of the order be also served on respondent no. 5 within one week by the petitioner.
