Two pistols and two magazines without any cartridges are said to have been recovered from the conscious possession of the petitioner for which petitioner is in jail custody since 08.05.2016.

Submission on behalf of the petitioner is that Section 26 and 35 of the Arms Act are not applicable and so far as Section 25 of the Arms Act is concerned, the same appears to be bailable in nature.

Considering the facts and circumstances of the case as well as the submissions of the parties and also keeping in mind that the petitioner has got no criminal antecedent, let the above named petitioner be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.37740 of 2016 (2) dt.15-09-2016 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-II, Munger in Jamalpur P.S.Case No.59 of 2016.
