Petitioner is accused in connection with Ara Mufasil P.S. Case No. 285 of 2015 registered under Sections 341, 323, 504 and 308/34 of the I.P.C.

The petitioner allegedly assaulted with Rami causing injury at the head of the informant. The Doctor has found incised wound on the middle scalp of the informant. The informant died after one and half months of occurrence in course of treatment.

Submission of the petitioner is that there is no Postmortem Report. Therefore, the cause of death is not established in this case. Petitioner is in custody since 17.08.2015,

Patna High Court Cr.Misc. No.42068 of 2016 (3) dt.13-12-2016 2/2 having no criminal antecedent.

Considering the nature of allegation and period already undergone by the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhojpur, Ara in connection with Ara Mufasil P.S. Case No. 285 of 2015 subject to the condition that the petitioner will fully co-operate with trial.
