The petitioners apprehend their arrest in Bodh Gaya P.S. case No. 102 of 2017 under Section 302, 201/34 of the Indian Penal Code.

The informant alleged that her husband had illicit relation with her elder sister-in-law, Rinki Devi. When the informant informed about the incident Balmukund Singh, elder brother of her husband, threatened to kill. The informant went to the residence of her father but on 12.02.2017 the informant came to know that Balmukund Singh, his wife Rinki Devi, Abodh Singh and his wife Neha Devi killer her husband.

The learned counsel for the petitioners submits that informant is not an eye witness of the occurrence. The deceased bolted the room from inside and committed suicide by hanging

During the course of investigation, the witnesses have stated that when they reached at the house of deceased and the petitioner, the room of the deceased was found locked from inside. The door was opened and dead body was brought down. The petitioners are wife of Balmukund Singh and Abodh Singh, brothers of deceased, Shashi Singh.

Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that the petitioners are ladies, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodh Gaya P.S. case No.102 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
