2. The petitioners seek regular bail in connection with Bihpur P.S. Case No. 370 of 2023 registered for the offence under Sections 147, 148, 323, 324, 307, 504, 506 of the Indian Penal Code.

3. As per prosecution case, allegation against the petitioners along with others is of assaulting the informant and hi son due to which they sustained injuries.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case due to dirty village

Patna High Court CR. MISC. No.25455 of 2024(2) dt.04-04-2024 2/2 politics. There is general and omnibus allegation against the petitioners. No specific overt-act attributed against the petitioners. It is further submitted that the petitioners are languishing in judicial custody since 9.2.2024. Moreover, similarly situated co-accused namely, Ranjan Sharma and Bale Sharma have already been granted bail by this Court vide order 31.10.2023 passed in Cr. Misc. No. 67531 of 2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Bihpur P.S. Case No. 370 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Naugachia in Bhagalpur.
