The petitioner apprehends his arrest in a case under Section 366A and other sections of the Indian Penal Code. The informant alleged that the petitioner enticed his daughter and many persons saw the petitioner taking away his daughter. It is submitted that the occurrence took place on 28.06.2013 but the complaint petition, on the basis of which the present F.I.R. was lodged, was filed on 05.07.2013. Prior to lodging of this case, the informant and others brutally assaulted the petitioner and other family members of the petitioner. For that, a case was lodged in Khanpur Police Station. During the course of investigation, the witnesses did not support the case of kidnapping of the daughter of the informant.
There appears that the informant made specific
Patna High Court Cr.Misc. No.49460 of 2014 (3) dt.21-05-2015 2/2 allegation against the petitioner that he kidnapped his daughter. The witnesses also saw the petitioner taking away his daughter towards Darbhanga. The victim is still traceless. Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Worisnagar (Mathurapur) P.S. Case No. 169 of 2013. Accordingly, the same is rejected.
