JUSTICE SUDHIR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.
The prosecution case is that a scuffle took place between the daughter of the informant and daughter of petitioner no. 2. The wife of the informant tried to bring calmness between them but petitioners having lathi and danda assaulted the wife of the informant and caused her head injury.
It is submitted on behalf of the petitioners that they have no criminal antecedent. The case is said to have been instituted only for petty reason. Subsequently, the matter has been compromised between the parties. From perusal of Annexure-2 series it would appear that the parties have already entered into a compromise and a petition to that effect has already been filed in the court below.
On behalf of the State, it is submitted that petitioners are named in the F.I.R.

No.48372 of 2015 (2) dt.01-02-2016 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Anwar Shamim, learned Judicial Magistrate, Ist Class, Bhagalpur, in connection with Kahalgaon(Rasalpur) P.S. Case no. 288 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
