ANJANA MISHRA ORAL ORDER 10-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. The petitioners apprehend their arrest in connection with Harsidhi P.S. Case No. 41/2017 registered for the offences punishable under Sections 147/149/323/324/307/436/379/504 of the Indian Penal Code.
It is submitted on behalf of the petitioners that the case is false and mischievous. The petitioners have been falsely implicated in this case on account of village rivalry. However, learned counsel appearing on behalf of the informant submitted that the petitioners are having criminal history and are in the habit of disturbing women of the village and
Patna High Court Cr.Misc. No.27262 of 2017 (2) dt.10-07-2017 P2/2 there is clear allegation against them and having indulged in injuring the informant's side and also have burnt the hut of the informant.
In view of the aforementioned facts and circumstances and there being criminal history, I am not inclined to grant anticipatory bail to these petitioners. It is, accordingly, rejected. (Anjana Mishra, J) Saif/- U T
