JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 29-07-2019 After some argument learned Senior Counsel for the petitioner submits that the petitioner may be permitted to surrender in the court below and on his surrender before the court below his prayer for regular bail be considered on its own merit and the same be not rejected only because this Court has not granted him anticipatory bail.
Learned counsel for the Bank as well as learned counsel for the State are present and have no objection to the same.
In the given facts and circumstances of the case, this application is permitted to be withdrawn with liberty to the petitioner to surrender in the court below within a period of four
Patna High Court CR. MISC. No.25246 of 2019(4) dt.29-07-2019 2/2 weeks from today and in case the petitioner surrenders and prays for regular bail in the aforesaid period, his prayer for bail shall be considered on its own merit without being prejudiced by the withdrawal of this application and the regular bail shall be considered on its own parameters.
