The petitioners apprehend their arrest in Mehandia P.S. case No. 32 of 2016 under Section 147, 149, 341, 323, 307, 379, 504 of the Indian Penal Code. Later on Section 302 of the IPC was added after death of Amarnath Rajbanshi, father of the informant.
The informant alleged that he had gone to do the work in the field along with his father and brother but her mother did not find cow-dung for which some altercation took place between petitioners, Rekha Kumari, Meena Devi and his mother. The petitioners are alleged to have caught hair of mother and sister-in-law of the informant. On alarm, Sadhu Rajbanshi,
Patna High Court Cr.Misc. No.27998 of 2016 (2) dt.02-09-2016 2/2 Santosh Rajbanshi, Mukesh Rajbanshi, Chameli Devi and Kiran Devi came at the place of occurrence having Lathi in their hands and they all assaulted the father and brother of the informant. Father of the informant died during the course of treatment. It is submitted that petitioners are not alleged to have assaulted either father or brother of the informant. The petitioners are alleged to have caught hair of the mother and sister-in-law of the informant.
Considering the fact that petitioners are not the assailants of the deceased and they are ladies, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in Mehandia P.S. Case No. 32 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
