The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,307 and 504/34 of the Indian Penal Code.

In the background of fight between the children of both sides the accused persons came variously armed and started assaulting the informant. It is specifically alleged that co accused Raghav Jha assaulted with knife to the informant when the petitioner assaulted with mungri on the head of the informant. The assault was also made by co accused Hare Kishun Mishra, Vikash Mishra and Surya Narayan Mishra. The injury on the head of the

Patna High Court Cr.Misc. No.49638 of 2015 (2) dt.06-11-2015 2/2 informant has been found to be simple in nature and the injury on the hand of the informant is amputation of finger which is alleged against co accused Raghav Jha.

It is submitted that there is counter version of the occurrence also. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Samastipur (Mufassil) P.S. Case No. 176 of 2015 pending in the court of learned SDJM, Samastipur. This application is disposed of with the aforesaid observation/direction.
