ANJANA MISHRA ORAL ORDER 11-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Piprakothi P.S. Case No.78 of 2017 (G.R. Case No.2299 of 2017) for allegedly having committed the offence under Sections 341, 323, 307, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that admittedly, the petitioner had fired in the air and, as such, the offence of Section 307 I.P.C. is not made out. He further submits that there is delay of five days in lodging the F.I.R. and there is case and counter case between the parties as another case, bearing Piprakothi P.S. Case No.74 of 2017, was

Patna High Court Cr.Misc. No.27283 of 2017 (2) dt.11-07-2017 2/2 also lodged by the petitioner against the brother of the informant, namely, Lal Bihari Yadav.

Considering the aforementioned facts and circumstances and the nature of allegations made and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Piprakothi P.S. Case No.78 of 2017 (G.R. Case No.2299 of 2017), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
