ANJANA MISHRA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehended his arrest in connection with Runnisaidpur P.S. Case No. 102/2016 registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.
Learned Standing Counsel Mr. Niraj Kumar, appearing on behalf of the Food Corporation submits that the other co-accused persons have been granted regular bail in connection with this case, after depositing Rs. 3, 16, 303/- in the department. Learned Senior counsel Mr. N.K. Agrawal appearing on behalf of the petitioner, however, submits that the present
Patna High Court Cr.Misc. No.26066 of 2016 (3) dt.23-08-2016 2/2 petitioner is merely a Contractual employee and he is willing to deposit 20 percent of Rs. 3, 16, 303/- within a period of six months. The said amount could be treated as the part of the alleged defalcation.
Considering the offer made by the petitioner and that there appears to be some serious discrepancies in the F.I.R., regarding the role of the present petitioner, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 102/2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
