JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 The petitioner apprehends her arrest in connection with Sakatpur P.S.Case No. 31 of 2018 registered under Sections 347, 363 and 366A of the Indian penal Code.

Allegation against the petitioner and other accused persons is of kidnapping the minor daughter of the informant. Submission of learned counsel for the petitioner is that petitioner is mother of Diwakar Singh and Prabhakar Singh and allegation of kidnapping is against them and further the statement of the victim girl recorded under Section 164 Cr.P.C. itself falsifies the prosecution case as she has not supported the allegation of kidnapping.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,

Patna High Court Cr.Misc. No.77773 of 2018(2) dt.02-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Darbhanga in connection with Sakatpur P.S. Case No. 31 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
