The petitioner seeks bail in connection with Sessions Trial No. 747 of 2022 arising out of Kursaila P.S. Case No. 84 of 2020 registered for the offence under Sections 447, 341, 323, 307, 147, 148, 149 and 379 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, the informant states
Patna High Court CR. MISC. No.23980 of 2023(2) dt.18-05-2023 2/3 that on 03.05.2020 at about 19:00 hours the informant was working at his Kamat, then Birha Yadav @ Vibhash Yadav, Maharana Yadav, Arjun Yadav along with 4 to 5 other unknown persons came there armed with Lathi-Danda and weapons and started abusing him and assaulted him with Lathi-Danda and when the informant tried stop them the accused persons also took away his mobile. The informant further alleged that when his father Mandal Mandal came to rescue, the accused persons assaulted his father also with Lathi-Danda. The accused persons fled away after firing in air. Thereafter, the informant was brought to Primary Health Centre, Kursaila where his treatment is going on.
Learned counsel for the petitioner submits that the petitioner is in custody since 23.08.2022 and the petitioner has falsely been implicated in this case due to dirty politics. Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the
