ANJANA MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 25(1B)A, 26/35 of the Arms Act and Section 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is merely a cleaner in the Rajhans Bus Services and only because of the fact that he had demanded the bus fare from the informant, the petitioner has been falsely roped in, in connection with the present case. It is further submitted that his name as alleged to have been taken by two co-accused persons has no evidentiary value.

No.27732 of 2017 (2) dt.13-07-2017 P2/2 In view of the facts and circumstances and also because the petitioner is having no criminal antecedent, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additonal Chief Judicial Magistrate, VIII, Aurangabad, in connection Salaiya P.S. Case No. 08/2015, with subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
