JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Naubatpur P.S. Case No. 261 of 2018 registered for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation is of recovery of one loaded pistol and one cartridge from co-accused, who disclosed the name of the petitioner stating that he had given the same to him. Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and he has no criminal antecedent.

Heard learned APP also.

In view of above facts and circumstances, let petitioner surrender before the court below and the court below shall verify the criminal antecedent of the petitioner and if it is

Patna High Court CR. MISC. No.21596 of 2019(2) dt.10-05-2019 2/2 found that he has no criminal antecedent, he shall be released on bail to the satisfaction of the court below itself, otherwise the court below is free to pass any other order(s) as it may deem fit and proper.

With the above observation, this application is disposed of.
