JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 436, 504, 506 of the Indian Penal Code. The prosecution case is that on 03.07.2015 at 4:30 A.M while the informant was repairing his house coaccused Sunil Yadav, Anil Yadav, Anjali Devi, Param Rekha Devi came and directed the informant not to make repair. The informant, in spite of protest continued repairing work when they called other accused persons, started abusing and making assault. When the informant tried to flee away co-accused Sunil Yadav resorted to throw arrow at him which hit on his neck as a result the informant received bleeding injury. The accused persons thereafter robbed the grains and other articles and put the informant's house on fire, as result 50% of the house got burnt.

Patna High Court Cr.Misc. No.25632 of 2016 (2) dt.28-06-2016 2/2 It is submitted by learned counsel for the petitioner that accusation is not specific against the petitioner. The petitioner being agnate of the informant has been roped in the present case in the background of Title Suit No. 5 of 2008 decreed in favour of the petitioner's family. Moreover the coaccused have been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 520 of 2016. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura(Ghailardh) P.S. Case No. 372 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
