2. The petitioner seeks bail in connection with Khagaria Mahila Case No. 21 of 2022 dated 09.07.2022, instituted for the offence punishable under Sections 498A and 506 of the Indian Penal Code.

3. Allegation against the petitioner is of assaulting, abusing, threatening to kill the informant and making viral of obscene photos, videos to the relatives of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the petitioner is the husband of the informant. Further, it is submitted that the petitioner never demanded dowry from the informant. It is also submitted that the petitioner is ready to keep his wife with full dignity and

Patna High Court CR. MISC. No.23900 of 2023(2) dt.23-05-2023 2/2 honour. Lastly, it has been submitted that the petitioner is in custody since 20.02.2023 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on provisional bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Khagaria in Khagaria Mahila Case No. 21 of 2022 with a condition that the petitioner after releasing on bail shall take his wife from her maternal house and keep the informant with full dignity and honour.

The learned court below is directed to keep watch on the conduct of the petitioner for six months and if the wife of the petitioner does not complain about the conduct of the petitioner, the court below shall confirm the provisional bail of the petitioner.
