The petitioner is apprehending his arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 379,504, 325, 506 of the Indian Penal Code. Prosecution case is that on the occasion of Shradh the informant went to his Sasural when all the named accused persons including the petitioner armed with Lathi, Danda and iron rod reached there. The petitioner Amit Kumar gave iron rod blow on the head of the informant with an intention to kill him, as a result of which he sustained head injury. It is further alleged that the other accused persons also assaulted the informant by means of lathi, danda and one Vishok Singh also snatched Rs.5000/- from the pocket of the informant.

It is submitted by the learned counsel for the petitioner that

Patna High Court Cr.Misc. No.25560 of 2016 (2) dt.24-06-2016 in the back ground of the land dispute being Title (Partition) Suit No. 61 of 2015/ 252 of 2007 the accusation has been levelled. The petitioner at the earlier point of time had also filed a case being Tekari (Panchanpur) P.S.Case No. 96/2016 against the informant side under sections 147, 148, 149, 341, 465 and 506 of the Indian Penal Code. The doctor found lacerated wound 2 1/2"x 1/2"x scalp deep on right occipital area, but all the injuries were found to be simple in nature caused by hard and blunt substance. It is also submitted that for the alleged occurrence of 23.3.2016, the First Information Report was registered on 26.3.2016 though the fardbeyan was recorded on 25.3.2016.

Considering the nature of accusation and in the back ground of litigated relationship between the parties, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within a period of twelve weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate IX, Gaya in Tekari (Panchanpur) P.S.Case No. 99/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Surendra/- U
