The petitioner seeks regular bail in connection with Janki Nagar P.S. Case No. 131 of 2018, registered for the offence punishable under Sections 147, 148, 149, 326, 307, 302 and 120(B) of the Indian Penal Code.
The allegation in the present case is regarding the accused persons having caught the hands and legs of the brother of the informant, whereafter, the co-accused namely, Shivan Rishideo cut the neck of the brother of the informant resulting in his death.
The learned counsel for the petitioner submits that there is no allegation of any assault having been committed by the petitioner herein and in fact, the injury which has led

No.79552 of 2018(2) dt.22-01-2019 2/2 to the death of the deceased i.e. cut mark on the neck is attributable to the co-accused Shivan Rishideo, hence, the petitioner is fit to be granted the privilege of regular bail. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 30.07.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Janki Nagar P.S.
