JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 The petitioners apprehend their arrest in connection with Naurangia P.S.Case No. 40 of 2018 registered under Sections 120B, 363 and 366 of the Indian penal Code.

Allegation as per the FIR is that one Umesh Yadav has enticed away the daughter-in-law of the informant and petitioner no. 1 and 3 being brothers and petitioner no. 2 being father of Umesh Yadav are involved in her abduction.

Submission of learned counsel for the petitioners is that a case has been lodged against the informant by the mother of the victim girl for committing murder and making the dead body traceless and in order to save his skin, petitioners have been implicated falsely; moreover the allegation is against Umesh

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Bagaha, West Champaran in connection with Naurangiya P.S. Case No. 40 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioners shall co-operate in the investigation otherwise their bail bonds shall be liable to be cancelled.
