Learned counsel for the petitioner submits that the petitioner had filed application form by speed post on 19.05.2023, vide application on the post of Driver in Bihar Agriculture University, Sabour, Bhagalpur vide pay scale Rs.5200-20,200/- in light of the Advertisement No.4/2023 but the respondents refused to accept his application without any reason.

A counter affidavit has been filed on behalf of the

Patna High Court CWJC No.6358 of 2024(3) dt.05-02-2025 2/2 University. It has been stated that the last date of submission of application form was 19.05.2023 and for the candidates working in any Government/ Semi Government Institution were required to send the application through proper channel to the prescribed address by 05.06.2023. Petitioner had sent his application form from Kahalgaon post office on 19.05.2023 at 16:39 P.M., but the last date of application to reach the Recruitment Cell, BAU, Sabour office was 19.05.2023. It is further submitted that the petitioner was a fresh candidate, therefore the terms and conditions fixed for candidates working in Government/ Semi Government Institution is not applicable for the petitioner. 4.

Considering the arguments advanced on behalf of the parties, I do not find any merit in the present writ application. It is, accordingly, dismissed.
