Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Athmalgola P.S. Case No. 185 of 2019 registered for offence punishable under sections 143, 341, 342, 323, 307, 302 of the Indian Penal Code.

As per prosecution case, Pappu Ram, the informant has stated in his fardbeyan that Suraj Singh, Golu Kumar, Ankul Kumar and Ravi Kumar with 3-4 unknown persons came by vehicle which injured the toe of Golu Ram (deceased), the son of the informant. On protest, the accused persons assaulted him

Patna High Court CR. MISC. No.34028 of 2021(2) dt.07-04-2022 2/2 with intent to kill. Co-accused Suraj Kumar, Ankul Kumar and Golu Kumar strangulated him to death.

The learned counsel for the petitioner has submitted that the petitioner is not named in the FIR and on similar footing, co-accused Ravishankar Kumar @ Chintu has been granted anticipatory bail by this Court, vide order dated 01.04.2022, in Cr. Misc. No. 33471 of 2021.

Considering the above-mentioned facts and circumstances, the petitioner Lalbabu Kumar @ Lallu Kumar, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Barh, Patna in connection with Athmalgola P.S. Case No. 185 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
