JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in Kamtaul P. S. Case No. 124 of 2016 registered for the offences under Sections 420, 341, 323, 504, 506 and 34 of the Indian Penal Code.
The petitioner is said to have received Rs.
1,20,000/- from the informant for managing Visa in favour of his son for visiting Malasiya, but he was given Tourist Visa and he was forced to return back to India from abroad. It is submitted by learned counsel for the petitioner that there is no evidence of giving money to the petitioner by the informant. The ticket for visiting Malaysia was purchased by the
Patna High Court Cr.Misc. No.24327 of 2017 (3) dt.12-06-2017 2/2 informant himself and not by the petitioner. The petitioner is quite innocent and has not committed any offence and he has been falsely implicated in the case by the informant. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Darbhanga in Kamtaul P. S. Case No. 124 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
