JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in connection with Punpun P.S.Case No. 74 of 2015 instituted under Sections 147, 148, 149, 323, 307, 379 and 504 of the Indian Penal Code.
The allegation against the petitioners and others is of assaulting the informant by means of iron rod and lathi. It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. They have falsely been implicated in the present case. It is a case and counter case between the parties.From perusal of the case diary it appears that there is no injury report to support of the allegation made in the FIR.
Patna High Court Cr.Misc. No.49396 of 2015 (3) dt.08-02-2016 2/2 On behalf of the State, it is submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Masaurhi at Patna in connection with Punpun P.S.Case no. 74 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
