JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 448, 342, 354, 504, 307, 379, 34 of the Indian Penal Code. The prosecution case is that the marriage of the daughter of the informant was settled with the brother of the petitioner Md. Jamshed but ultimately the marriage broke down due to the dispute with regard to the fulfilment of the dowry demand. Thereafter all the accused persons entered into the house of the informant when co-accused Md. Jamshed made assault with knife to the daughter of the informant and the other accused persons including the petitioner took away jewellary and other articles.
It is submitted by learned counsel for the petitioner that in view of the dispute with regard to the settlement of marriage the accusation has been levelled and the
Patna High Court Cr.Misc. No.25258 of 2016 (2) dt.21-06-2016 2/2 thrust of accusation is against Md. Jamshed.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Narpatganj(Ghurna) P.S. Case No. 81 of 2016, pending in the Court of learned Chief Judicial Magistrate, Araria. With the observations above, the application stands disposed off.
