JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-07-2020 Heard Dr. Anjani Prasad Singh, learned counsel for the petitioner, Mr. Nand Kishore Prasad, learned A.P.P. for the State and the learned counsel for the informant through Video Conferencing.

The petitioner seeks bail in Chewara P.S. Case No.39 of 2019 registered under Sections 341, 354(B) of the Indian Penal Code and under Section 8 of the POCSO Act. The informant alleged that at 4 a.m. on 15.09.2019, his daughter had gone to attend the call of nature but the petitioner caught her with bad intention. On alarm, the informant went there but the petitioner fled away. The informant further alleged that petitioner is a man of bad character and he has also tried to outrage the modesty of his wife on earlier occasion.

No.21327 of 2020(2) dt.23-07-2020 2/2 The learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the case on account of being co-villager of the informant. Petitioner is alleged to have caught the daughter of the informant and for that the petitioner is in jail since 23.11.2019. Petitioner has already remained in jail for about eight months. Learned A.P.P. opposed the prayer for bail.

Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner has remained in jail for about eight months, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. I, Sheikhpura in connection with Chewara P.S. Case No.39 of 2019.
