This application is for grant of bail in connection with Bhagwan Bazar P.S.Case no.203 of 2018for the offences under Sections 364/34 of the Indian Penal Code. Allegation against the petitioner is that one Dinesh Rai called brother of the informant and took him, thereafter brother of the informant did not return and when he inquired about him from Dinesh Rai, he shown his ignorance and it is also stated that friend of Dinesh Rai informed that his brother has been murdered. The petitioner is not named in the FIR and it further appears that he is accused in a case under Sections 399 and 402 of the IPC and also under Sections 26/35 of the Arms Act.
Submission of the learned counsel for the
Patna High Court CR. MISC. No.25869 of 2019(3) dt.03-07-2019 2/2 petitioner is that except confessional statement there is nothing against him.
Heard learned A.P.P., who has opposed the prayer for bail stating that in the confessional statement name of the petitioner also transpired as the person conspiring with the other accused persons apart from the criminal antecedent. . In view of the facts as stated above and in view of the fact that the investigation is going on, I am not inclined to grant privilege of anticipatory bail to the petitioner and if possible to be disposed of on the same day.
