====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in connection with a case registered for the offence under Sections 302/34 of the Indian Penal Code. He is named in the First Information Report along with six others including the wife of the deceased. It is said that petitioner, five others named in the First Information Report and the deceased were taking drink in a room which was later found bolted from out side and after the room was broken open by the son of the deceased- informant, his father was found dead and in these circumstances, petitioner and others have been named in the case.
From the post-mortem report, it appears that the deceased suffered an unnatural death by hanging.

No.1085 of 2015 (5) dt.22-05-2015 2/2 In such circumstances, I am not inclined to admit the petitioner to the privilege of bail in the event of arrest though it is said that other four out of the five have been admitted to the privilege of bail in the event of arrest by another Bench of this Court under order dated 26.11.2013 passed in Cr. Misc. No. 19317 of 2013 with direction to the informant to become one of the bailors.
Let petitioner surrender in the court of Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 39 of 2013 within four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail which should be considered in accordance with law as also in the light of the order passed by the High Court in the case of co-accused.
