The petitioner is in custody in connection with Paroo P.S. Case No. 90 of 2020, for the offence under Sections 270. 272 and 414 of the Indian Penal Code and Sections 30, 30(a)(c) (d), 33 and 36 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 14.02.2020. He further submits that in the instant case total 25 litres of spirit was seized from a plastic gallon. Learned counsel for the petitioner submits that nothing was recovered from conscious possession of the petitioner.

Considering the fact that the petitioner has no criminal
