Three petitioners, who are father -in- law and brother of the husband of the deceased respectively, have prayed for grant of anticipatory bail in connection with Jalalpur P.S. Case No. 71 of 2016 registered for the offence under section 304B, 328 and 34 of the Indian Penal Code.

It was submitted by learned counsel for the petitioners that in the case husband is already in custody. He further submits that there is no specific accusation against any of the petitioners. He further submits that due to mistake the deceased had consumed different medicine, which was poisonous. On this very ground a

Patna High Court Cr.Misc. No.26536 of 2016 (2) dt.04-07-2016 2/2 prayer has been made for grant of anticipatory bail whereas Sri Shailendra Kumar, learned A.P.P. opposing the prayer of bail submits that marriage had taken place only three years back and during investigation witnesses have supported the prosecution case.

Keeping in view the nature of accusation , I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
