Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Sigori P.S. Case No. 75 of 2018 corresponding to Special Case No. 9471 of 2018 instituted for the offence under Sections 30(a), 37(a) (b) and (c) of Bihar Excise and Prohibition Act, 2016.
Counsel for the petitioner submits that from the seizure list it appears that recovery has been made from the paddy field which does not belong to the petitioner. He further submits that petitioner has been arrested on the allegation that
Patna High Court Cr.Misc. No.1884 of 2019(2) dt.15-01-2019 2/2 he was in intoxicated condition.
Petitioner is in custody since 8.10.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Sigori P.S. Case No. 75 of 2018 corresponding to Special Case No. 9471 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
