ANJANA MISHRA ORAL ORDER 01-07-2017 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Gopalpur (Rangra) P.S. Case No.173 of 2016 for allegedly having committed the offences under Sections 399, 402, 216 and 216A of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioners submits that admittedly, the raid was conducted in the Baithaik of one Ramautar Mandal and from the said place, 6-7 miscreants were said to have started fleeing and the petitioners are alleged to be amongst them as per the statement made by the villagers. Thus, it is submitted that it is only on mere suspicion that the
Patna High Court Cr.Misc. No.27705 of 2017 (2) dt.01-07-2017 2/2 petitioners have been named in the F.I.R.
Considering the aforementioned facts and circumstances and that there is no recovery from the conscious possession of the present petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, III, Naugachhia, Bhagalpur, in connection with Gopalpur (Rangra) P.S.
