JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 This is an application for grant of anticipatory bail in connection with Khagaria Mufassil P.S. Case No. 206 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 302, 448 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and several other accused persons is that they have surrounded the brother of the informant and on the order of Chandradeo Yadav, Anuj Yadav fired upon the brother of the informant with rifle due to which he died and thereafter co-accused Brajesh Yadav caught the informant and Rajendra Yadav also shot at the informant. Further, there is also allegation of firing against co-accused Manish Yadav with intention to kill the informant. Submission of learned counsel for the petitioner is

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria, in connection with Khagaria Mufassil P.S. Case No. 206 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
