The petitioner seeks bail in connection with Isuapur P.S. Case No. 41/2018 registered under Sections 341, 323, 379, 307 and 34 of the Indian Penal Code.

The petitioner and other accused namely, Govind Manjhi are said to have got executed registered sale deed of land from nephew of the informant namely, Nitesh Kumar Singh and on protest made by the informant they assaulted on the neck of Nitesh Kumar Singh by mean of Fasuli by calling him from his house.

It is submitted by learned counsel for the petitioner that no such offence has ever taken place. Petitioner has been

Though two injuries on the neck of the victim were found by the doctor but both have been opined as simple in nature and similarly situated co-accused Govind Manjhi has been enlarged on bail by the learned lower court. Petitioner has no criminal antecedent and has been languishing in custody since 10.12.2018. On the other hand, learned A.P.P. opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Saran at Chapra in connection with Isuapur P.S. Case No. 41/2018.
