====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 25-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Arwal P.S. Case No. 401 of 2020 lodged under Sections 379 and 414 of the Indian Penal Code.

The prosecution case is that the ASI, Arwal along with associates noticed cutting iron window on the third flour of Md. Shaif with the help of gas cutter and 5-6 persons were standing on the ground near the same building upon chase only one accused Nawab Alam was caught and on his confessional statement, name of both the petitioners have figured in this case along with other. Learned counsel for the petitioners further submits that petitioners are in custody since 05.12.2021. It has

been alleged that other co-accused and similarly situated accused persons have granted bail by the Co-ordinate Bench of this Court vide order dated 08.02.2021 passed in Cr. Misc. No. 49330 of 2021 and vide order dated 15.07.2021 passed in Cr. Misc. No. 21906 of 2021.

Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances and submissions made above of this case, let the petitioners are granted on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Arwal in connection with Arwal P.S. Case No. 401 of 2020, subject to the conditions as laid down under Section 437(3) of the Cr.P.C.

The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.
