JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the complainant and his marriage was solemnized in the year 2011 but subsequently, dispute arose between the petitioner and complainant resulting filing of the present case. It would appear from perusal of the impugned order that learned Sessions Judge took several attempts to patch up the dispute of the parties but he could not succeed and taking note of the aforesaid fact, this Court had issued notice to the complainant but in spite of service, she did not choose to appear before this

The above stated conduct of the complainant reflects that she is not interested to lead her conjugal life with the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Siwan in Complaint Case No. 2459 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
