JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-06-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the daughter of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 304B, 323, 504 and 386 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant within two years of the marriage for non-fulfillment of the dowry demand.
It is submitted by learned counsel for the petitioner that the victim was mentally abraised and she went traceless and in spite of search, she could not be found.
Considering the fact that thrust of accusation is against the petitioner, this Court is not inclined to grant anticipatory bail
Patna High Court Cr.Misc. No.25948 of 2016 (2) dt.23-06-2016 2/2 to the petitioner.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Motihari Muffasil (Lakhaura) P.S. Case No. 439 of 2015.
Accordingly, the application is disposed of.
